Terms of Athlete Booking & Events
1. Agreement
Before proceeding, it is important that the individual or entity submitting a booking request (the "Client", "you" or "your") reads, understands and agrees to the terms set out in this document (the "Agreement").
By submitting a request, accepting a quote, purchasing a ticket, or otherwise proceeding with a booking facilitated by Pro2U ("we", "us", "our"), you acknowledge that this Agreement forms a binding legal agreement between you and Pro2U.
Pro2U operates as an athlete experience facilitation platform, connecting clients with professional athletes (the "Athlete") for personal, business, and group-based experiences (each an "Engagement").
2. Nature of Pro2U’s Role
2.1 - Pro2U acts solely as a facilitator of introductions, bookings, logistics, and payments.
2.2 - Pro2U is not a talent management agency and does not employ, represent, or control Athletes.
2.3 - Each Engagement constitutes a separate agreement directly between the Client and the Athlete.
2.4 - Pro2U is not a party to the performance of the Engagement itself.
3. Eligibility & Authority
By proceeding, you warrant that you:
Are at least 18 years of age;
Have authority to enter into the Engagement on behalf of yourself or your organisation; and
Have read, understood, and accepted this Agreement.
4. Booking Requests & Confirmation
4.1 - Submitting a booking or quote request through Pro2U is free and non-binding.
4.2 - All bookings are subject to Athlete availability and acceptance.
4.3 - An Engagement is only confirmed once:
The Athlete has accepted; and
The required deposit has been paid.
5. Fees, Deposits & Payments
5.1 - The quoted price (“Engagement Fee”) is payable in Australian Dollars unless otherwise stated.
5.2 - A 10% deposit is required to secure the Athlete’s availability and booking date.
5.3 - The remaining balance must be paid prior to the commencement of the Engagement.
5.4 - Pro2U may charge a service or facilitation fee, which is included in the quoted price.
5.5 - Payments are processed via approved third-party payment providers.
6. Group Events & Ticketed Experiences (Pro2U Events)
6.1 - Pro2U may offer group-based or ticketed events (“Pro2U Events”).
6.2 - Tickets are sold on a per-person basis and are subject to capacity limits.
6.3 - Tickets are non-refundable but may be transferred to another person with at least 48 hours notice to Pro2U at enquiries@pro2u.com.au
6.4 - Clients acknowledge that group events involve shared participation and limited individual interaction time.
6.5 - For ticketed group events, Pro2U's separate Refund Policy applies and is available on our website.
7. Cancellations – Client
7.1 - For business and private bookings, if a Client cancels:
More than 48 hours before the Engagement, the deposit will be refunded;
Within 48 hours, the deposit becomes non-refundable and is paid to the Athlete.
7.2 - For ticketed group events, Pro2U's Refund Policy applies in place of this clause.
7.3 - Failure to attend a confirmed Engagement may result in forfeiture of all payments.
8. Cancellations – Athlete
8.1 - Athletes may become unavailable due to unforeseen circumstances.
8.2 - Where possible, Pro2U will attempt to arrange a suitable replacement.
8.3 - If no replacement is available, payments will be refunded in accordance with this Agreement.
8.4 - Pro2U is not liable for indirect or consequential losses arising from Athlete cancellation.
9. Event Conduct & Safety
9.1 - Clients are responsible for ensuring that venues are safe, suitable, and compliant with applicable laws.
9.2 - Pro2U and Athletes reserve the right to withdraw from an Engagement if safety, conduct, or environmental concerns arise.
9.3 - Special conditions apply where minors are involved, including parental consent and supervision.
10. Promotion, Media & Content
10.1 - Any filming, photography, or promotional use involving an Athlete must be agreed in advance.
10.2 - League, sponsorship, and branding restrictions may apply.
10.3 - Pro2U may use approved content from Engagements for marketing and promotional purposes.
11. Limitation of Liability
To the maximum extent permitted by law:
Pro2U excludes all liability for loss, injury, or damage arising from an Engagement.
Pro2U’s total liability is limited to the fees paid for the relevant booking.
12. Amendments
Pro2U may amend this Agreement from time to time. Continued use of the platform constitutes acceptance of the updated terms.
13. Governing Law
This Agreement is governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
